1. Acceptance of Terms

By accessing or using the PBC Empresa, PBC GO applications or the website primebclub.com (the "Services"), operated by Prime Build Club LLC ("PBC"), you agree to comply with these Terms of Use. If you do not agree with any part of these terms, do not use our Services.

2. Description of Services

PBC is a business management platform focused on the construction industry, offering:

• Estimate and invoice generation and management
• Employee time tracking with GPS
• Project and job site management
• Financial management (income, expenses, payroll)
• Team management and job postings
• Marketplace for buying/selling businesses
• Materials and equipment store
• Blueprint analysis with artificial intelligence
• Profit calculator and investments
• Social network and internal communication
• Corporate radio
• Service subcontracting
• Inventory management

3. Registration and Account

• You must be at least 18 years old to use our Services.
• Information provided during registration must be truthful and up to date.
• You are responsible for maintaining the confidentiality of your account and password.
• Notify us immediately of any unauthorized use of your account.
• An account represents either a company or an individual employee.

4. Acceptable Use

By using the Services, you agree to:

• Not use the Services for illegal or unauthorized purposes
• Not transmit viruses, malware, or malicious code
• Not attempt to access other users' data without authorization
• Not copy, modify, or distribute the software without authorization
• Not use the system to send spam or unsolicited communications
• Maintain your employee and client data in compliance with applicable labor and privacy laws

5. User Content

You are responsible for all content you submit, post, or store through the Services, including estimates, invoices, financial data, photos, and messages. PBC does not claim ownership of your content, but you grant us a limited license to process, store, and display such content as necessary to provide the Services.

6. Plans and Payments

• PBC offers free and premium (subscription) features.
• Subscription prices are available in the app and may be changed with 30 days' notice.
• Payments are processed through the Apple App Store or Google Play Store.
• Cancellations can be made at any time through the respective app store.
• We do not offer refunds except when required by law or app store policies.

7. Employer-Employee Relationship

PBC is a management tool. The use of the application for time tracking, team management, and payroll does not create any employment relationship between PBC and its users. Responsibility for labor compliance rests entirely with the employer using the platform.

8. Artificial Intelligence

Our AI features (blueprint analysis, automatic estimates) are provided "as is." Results generated by AI are estimates and should not be considered as professional opinions. We recommend that you verify all automatically generated results before using them in business decisions.

9. Intellectual Property

The software, design, logos, trademarks, and content of PBC are the exclusive property of Prime Build Club LLC. No license is granted beyond the right to use the Services according to these Terms.

10. Limitation of Liability

PBC is provided "as is" and "as available." To the maximum extent permitted by law:

• We do not guarantee that the Services will be uninterrupted or error-free
• We are not responsible for financial losses resulting from the use of calculations, reports, or estimates generated by the system
• We are not responsible for business decisions made based on application data
• Our total liability is limited to the amount paid by you in the last 12 months

11. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time. After termination, your data will be retained for 30 days and then permanently deleted, except when retention is required by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated through the app or email with at least 15 days' notice. Continued use of the Services after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the United States of America. Any dispute shall be resolved in the competent courts of the state where Prime Build Club LLC is registered.
